MEMBERSHIP AGREEMENT

Please read these “site terms of use” carefully before using our site.

Customers who use and shop on this shopping site are deemed to have accepted the following terms:

The web pages on our site and all pages linked to them belong to and are operated by the company ISI MATİK TEKNİK MALZEME TİCARET VE SANAYİ LİMİTED ŞİRKETİ at www.isimatik.com. By using all services offered on the site, you agree that you are subject to the following terms, have the legal capacity, authority, and right to enter into this agreement under applicable laws, are over 18 years old, and that you have read, understood, and accepted the terms written in this agreement.

This agreement is indefinite and imposes rights and obligations related to the site on the parties. The parties declare and undertake that when they accept/approve this agreement online or in writing, they will fulfill these rights and obligations completely, correctly, and timely, within the conditions requested in this agreement.

1. RESPONSIBILITIES

• The company reserves the right to change prices and offered products and services at any time.

• The company undertakes that the member will benefit from the services subject to this agreement except in cases of technical failures.

• The user agrees not to perform reverse engineering on the site or engage in any activity aimed at discovering or obtaining the source code. Otherwise, the user accepts responsibility for any damages caused to third parties and acknowledges that legal and criminal proceedings may be initiated against them.

• The user accepts responsibility solely for any damages arising from providing incomplete or incorrect information during membership registration. In case of false information or breach of this agreement by the member, the company reserves the right to terminate the membership unilaterally without any notice or warning.

• For the improvement and development of the website and/or within the framework of legal regulations, certain information such as the Internet Service Provider’s name used to access the site, Internet Protocol (IP) address, date and time of access, pages visited during the session, and the website that directly linked to the site may be collected. The user consents to the collection of this information.

• The user agrees not to produce or share content within the site or its communications that is contrary to public morality and decency, illegal, infringing on third parties' rights, misleading, offensive, obscene, pornographic, damaging to personal rights, infringing copyright, or encouraging illegal activities. Otherwise, the user is fully responsible for any damages, and site authorities reserve the right to suspend or terminate such accounts and initiate legal action. The site also reserves the right to share information about user accounts with judicial authorities upon official request.

• Relationships among site members or between members and third parties are the sole responsibility of the users themselves.

2. INTELLECTUAL PROPERTY RIGHTS

3.2. These personal data may be used within the company to profile customers, offer promotions and campaigns suited to the profile, and perform statistical studies.

3.3. The user has the right to revoke the consent given in this agreement without any reason. The company shall process this revocation immediately and cease electronic communications within 3 (three) business days.

3.4. Confidential Information may only be disclosed to official authorities if requested in accordance with due legal procedures and mandatory legislation.

4. NO WARRANTY

THIS CLAUSE SHALL BE VALID TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. SERVICES PROVIDED BY THE COMPANY ARE OFFERED "AS IS" AND "AS AVAILABLE" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, WHETHER STATUTORY OR OTHERWISE, REGARDING THE SERVICE OR APPLICATION (INCLUDING ALL INFORMATION CONTAINED THEREIN).

5. REGISTRATION AND SECURITY

• The user must provide accurate, complete, and up-to-date registration information. Otherwise, this Agreement will be considered violated, and the account may be closed without notice.

• The user is responsible for the security of passwords and accounts on the site and third-party sites. The company is not liable for any data loss, security breaches, or damage to hardware and devices due to negligence.

6. FORCE MAJEURE

If the obligations under this agreement cannot be fulfilled due to reasons beyond the parties' control, such as natural disasters, fire, explosions, civil wars, wars, rebellions, popular movements, declaration of mobilization, strikes, lockouts, epidemics, infrastructure and internet failures, power outages (collectively “Force Majeure”), neither party is liable. During this time, the rights and obligations of the parties arising from this agreement are suspended.

7. ENTIRE AGREEMENT AND SEVERABILITY

If any provision of this agreement becomes partially or fully invalid, the remainder of the agreement remains valid.

8. CHANGES TO THE AGREEMENT

The company may partially or fully change the services offered on the site and these agreement terms at any time. Changes become effective on the date they are published on the site. It is the user’s responsibility to follow changes. Continuing to use the services implies acceptance of these changes.

9. NOTIFICATIONS

All notifications regarding this Agreement will be sent to the company’s known e-mail address and the user’s e-mail address provided in the membership form. The user agrees that the address they provided at registration is the valid notification address and will notify the other party in writing within 5 days in case of change. Otherwise, notifications sent to this address shall be deemed valid.

10. EVIDENCE AGREEMENT

In any disputes arising from this agreement, the parties’ books, records, documents, computer records, and fax records will be accepted as evidence according to the Turkish Code of Civil Procedure No. 6100, and the user agrees not to object to these records.

11. DISPUTE RESOLUTION

Courts and enforcement offices of Istanbul (Central) Courthouse shall have jurisdiction over any disputes arising from the implementation or interpretation of this agreement.

• Records formed through forms related to your complaints

If you grant Electronic Commercial Communication Permission;
